LIMITED WARRANTY

Marshall Underwater Industries, Inc. products are warranted against mechanical, electrical, and physical defects for a period of one year from the date of shipment from the factory, if they have been properly used and are warranted to be merchantable and fit for the ordinary purposes for which such products are used. THERE ARE NO EXPRESS WARRANTIES OF FITNESS FOR ANY PARTICULAR PURPOSE, or any implied warranties other than those made expressly herein, ALL SUCH WARRANTIES BEING EXPRESSLY DISCLAIMED. THE OBLIGATION OF MARSHALL UNDERWATER INDUSTRIES, INC. under this limited warranty including THE LIMITED WARRANTY OF MERCHANTABILITY AND FITNESS FOR THE ORDINARY PURPOSE FOR WHICH THE PRODUCTS ARE USED and all other warranties IS LIMITED TO THE FURNISHING OF NEW PARTS FREE OF CHARGE in exchange for parts which have proven defective and does not include any other costs such as the cost of removal of defective part, installation, labor or consequential damages of any kind, the exclusive remedy being to require such new parts to be furnished. Marshall Underwater Industries, Inc. assumes no responsibility for proper selection and installation of its products.
